Oh, we have done all of that. We have filed MANY motions with extensive case law examples. We have called them out many, many times and slapped them in the face with other cases that Carrington has lost, but the just keep spewing the same garbage about how the note and all other relevant documents that show they had standing were filed in the state action and already went before a judge, yet they continue to refuse to produce those documents to show us.

I'm wondering if you need to be in State Court on your claim(s) against Carrington. It sounds like you need to formalize a discovery request. If they don't agree to produce the documents, this can be held against them. This is NOT unusual. They are counting on you not doing this or contesting their lack of cooperation with the Judge.

Another thing to take into consideration is that if they modify your loan while it might enable you to stay there but it doesn't mean the terms will be better. That's part of the whole scam. Unless they have to forgive principal or arrears you'll end up far more indebted than you were. While the missed payments have been earning interest at the note rate so have the charges and late fees. When they modify the new ballooned principal even at a reduced interest rate it will considerably increase the total payments on the new loan. Basically they are capitalizing the debt and then earning interest on interest.

One thing that might be useful in persuading them to negotiate with you would be filing a complaint with the CFPB. Sometimes that will light a fire under them.

The CPFB is completely useless. They are not the organization that they once were. We already filed a complaint with the CFPB back in early October, only for the complaint to be closed as soon as Carrington responded with their totally BS drivel and nothing ever came of it.

We ended up purchasing a new home and are in the process of coming to a monetary settlement with Carrington.
