HARP Seasoning Requirement-Different for own servicer?

I sold a rental property via short sale in 2/11. I'd LOVE to refinance my underwater primary, but understand there is a 3-4 year seasoning requirement (3 or 4 years seems to vary on who you ask). B of A, my loan servicer, keeps sending me fedex invitations to refinance under HARP. They were my servicer for the rental and my primary property so the short sale is in there records.

Should I bother responding? Can they as my servicer "waive" the seasoning requirement? I'm not sure why they would be sending me this if they know I don't qualify.

They may be automatically generating these letters and sending them out to people in situations like yours. Ie: Owned by Fannie/Freddie and originated prior to May 31st, 2009. And depending on the servicer there is a difference between the "Same Servicer" HARP program and "Open Access".

Same servicer may allow some exceptions to be made, but I can't confirm or deny and would say it might be worth looking into.
