Anyone heard of an Arbitration & Negotiation Specialist?

I'm being sued by one of my credit card and instead of hiring a lawyer, there's this arbitrator that gets his businesses from superior court that helps people that are being sued by credit card companies. He said he can stop the litigation and work with them and try to settle, or setup a payment plan what is comfortable to me, for a possibility of settling in the future. He said he's worked with the atty's office that is suing me and have had success of settling. Anyone heard of an Arbitrator and Negotiation specialist before? I have only a couple days to file my "Answer to Complaint" that my debt settlement company prepared for me but this guy said don't file it because it'll just piss off the atty's office and they'll see that as a stall tactic. What to do?

I'm sorry but I am unable to locate any information about this business because the name "Arbitrator and Negotiation" is very generic. Can you please provide a link to the site you are referring to so we can look them up as well to help determine their legitimacy.

HI Evan - they've been in business for about 6 yrs. and he doesn't have a website. he barely put up a facebook page and you can go here for that. he has a video on what they do. He's send me samples of letters from cc companies that was sent to him on behalf of his clients. He's stopped litigation and start dealing with law offices that cc companies hired for the lawsuit. he doesn't charge very much and he lowered my fees knowing i'm going through a lot right now (including trying to settle my 2nd that has a sale date that keeps getting postponed, you might remember, i have threads here for that). Anyway so below is the link. He also said that he gets his business purely from Supreme Court and referrals so no need for a website. Hope you can give me your input. I'm planning on trying him out now since i have to file a response by Friday to meet my 30 day deadline to do something before the Attys office files a judgement on me or something. ANd this guy says even if i don't hire him, i have to do something and he can educate me on what he knows and what i need to do.... but he said do not file my response. I figure if I file the response, it costs me $375 (might be able to wave it) and he charges only $300 and he'll do it all....

This does sound promising and he seems to be giving you sound advice as most scams would just want your money without offering you any information about the process. I can't really give an educated opinion about this individual because there is really nothing about him or his "business" anywhere on the net besides this Facebook page he set up on December 2nd, which does sound pretty fishy to me.. It is hard to tell if Kettner Cassidy is even his real name.. How did you first come into contact with this individual?

I definitely remember your situation and that the 2nd mortgage has been filing a sale date against your property even though the account is underwater. I've been wondering if this is gonna be a new scare tactics lenders use to try and get as much money as they can out of the borrower. Besides yourself I think there is only one other person here that is in a similar position as yourself and I believe there sale date was postponed as well. I'm very sorry I cannot offer more advice on this subject but there is really not much information to research about this individual or the exact process he takes to complete this task..

Thanks Evan.. no problem. I did the same, looked him up on internet but nothing. He is local though and has an office in San Diego. since he told me he gets his business from Supreme COurt, i figured he came accross my name from court. He contacted me once and that's how we got in touch. I will try him out, and see where this takes me since I have to take action anyway asap. Anything to stall the litigation will help. He said whatever he's doing, i can actually do myself but ppl get intimidated when dealing with Atty's office that is trying to sue them and that's his specialty. He's an arbitrator. Will keep you posted though. Thanks so much!

In regards to my 2nd, will keep that thread updated soon. It's been postponed the 3rd time, a week at a time and my atty said this is their way of hoping i can come up w/ the money they are asking for. we are not even so far apart from our offers... they want 15K and i offered 10-12K. we check every friday if sale is on and they keep postponing it.. If they keep it and goes on and we check on the day of, we WILL file.

I was contacted by this firm over this past weekend and as mentioned in this conversation above, there is really nothing on the internet about him... no website, no information on the owner... NOTHING! I was writing to see if you ever ended up using him for your arbitration/negotiation needs and if so, is he legit, did you have a good experience? Any information would be much appreciated! Welcome and thanks for joining the LoanSafe community.

This alone is never a good sign! Always be VERY wary of any individual or firm that reaches out to you and offers assistance, especially when they don't have a legitimate website or reviews for you to check out. Are you being sued by your credit card holder?

Yes, I'm being sued by my credit card holder. $5,000 debt + interest, fees, etc. etc. which probably brings it to about $6,500. This man had reached out to me via email and had left his phone & a Facebook page link. I asked him how he got my work email out of all things and he said he had did a "quick" or "bop" search on me (I forget the terminology he used) through Google. I did one myself and found a document that was out there with my work email on it. So I decided to call this firm, I left a message, he called back and was actually very helpful and informational. He said he used to work for these credit collection firms, he knows the in's & out's and all the tactics they use to scare you, threaten you, etc. He would charge me less than 10 percent of my total debt for his services. He said he would arbitrate my case and deal with my credit card holder directly. He said some paperwork would be filed which would completely cut the collection law firm out of the mix and let him deal with the credit card company directly to negotiate a settlement. He did say that if I did decide to employ his services he asked that I let him do "his thing" with the cc holder and not get involved with the arbitration process because it could mess things up. He said collection firms usually don't end up getting paid at all so what they wish for is a Judgement (which he said I personally do not want) because a judgement can garnish wages, SS, property, etc. So to sum it up.... this guy seemed pretty straightforward, polite, very knowledgeable but again still weary because I can't find anyone out there who has used him. Plus, his fees of less than 10 percent sound too good to be true (well at least to me). What do you think?!

that we thought were being handled by a company called Credit Solutions. Kettner Cassidy intervened at the urging of my wife to contact the attorney who threatened to garnish my wages. They worked out a payment arrangement that I'm able to afford and gave us tips on how to avoid being scammed by debt settlement companies and attorney's. The owner use to manage large collection law firms and put our concerns at rest. He does not publish a website, primarily to prevent others from mimicking his service offerings! I was uncertain in the beginning but now I know from personal experience that he is legitimate.

sorry for late response on this.. just been busy with everything the last couple of months..
Anyways, i did have a good experience with Kettner and Cassidy when I needed his help. His charge was very affordable and he was very very helpful. Nice man and I would recommend him. We ended up not going through the process with the law firm that my credit card company used is because i had to deal with my house issues and ended up filing an emergency bk (but didn't end up going through all the way with bk, just needed to do it to hault any process ie. auction). So the law office no longer contacted me due to this bk filing. By the time I resolved my house issues, i believe the credit card company that was suing me ended up pulling all their accounts/files out of the law firm and my file/account included so i believe I am not being sued anymore. I started to get the normal letters from collection agency again and not from law office for this cc account of mine so seems like they started from scratch. I"m crossing my fingers that they just cancel my debt soon. I've had 2 acct cancelled by chase last year so I'm hoping this would too.

Kettner and Cassidy gave me tips and educated me on how to deal with cc companies, collection agencies and how to find out of collection agency is legit and not debt buyers. he is a very nice guy.

First off no one reading this would believe you have only had 1 gripe out of 4200. If your company is so efficient why not advertise, or build a website or have some sort of web presence? Maybe there is little online about you because of these bullying tactics and sharing of personal, private communications.

Secondly I will not get into the inaccuracies or details you have left out of your rant. I tried to keep this private and your company chose to defame and slander my name. Do you share all your clients private communications? Are you familiar with the term breach of fiduciary duty? You were entrusted with private information and chose to share it publically

I gave your company multiple opportunities to fix a perceived wrong. Privately. You chose to share personal information publicly. Given a second chance I personally would reconsider doing business with a company like this again.

I came across this post and I felt it was necessary to put in my two cents about Kettner Cassidy. This company bailed me out of a rough period in my life when I lost my job. I found out about them from a co-worker who used the service and had only positive things to say about their “hands on approach” to fighting on his behalf. I wasn’t too concerned about them being legitimate because of my co-workers experience with them, which helped in me making my final decision to retain their services. I’m glad I did, because I was able to avoid bankruptcy and also pay a much smaller amount back to my creditors. I can’t speak for everyone’s experience on this thread, but mine worked out great…thank God! Creditors were driving me nuts and they were successful in getting them off my back. Needless to say, NO more credit spending for me, unless it’s an emergency. I referred a family member to them and it worked out well for her too, even though she owed a lot more than I did.

It looks as though Kettner Cassidy did the right thing and removed my personal information from this forum. I would never trust a company that chose to do that in the first place. It is both unethical and illegal. Although it seems MMM may be KC in disguise.

I had the huge misfortune to be contacted by Jim Philips at Kettner Cassidy when a creditor filed a suit against me for an unpaid debt. I completely ignored the alarms that were going off and did decide to pay him for his services. I presented Jim with many different scenarios I was willing to pay and each time he told me that he could absolutely beat the offer I had negotiated with the creditor. I trusted Jim when he told me many times not to worry that he was looking out for me. When the time came to sign the final offer it was almost exactly the same as what I had worked out on my own. I paid him for absolutely nothing. In this day and age I cant believe I trusted a company with no website, no BBB listing and no online reviews. Its almost as if they try to hide the truth.

He is a fraud and a liar. Trolls u, tells you what you want to hear and then does not produce. most of these comments are probably written by him. Please for your own sake do not use this con artist. I am seeking legal and criminal charges. He is not who he presents himself to be. protect yourself and your family.i cannot warn you enough.
